Who we are and our role
DAVAR represents creditors in resolving unpaid claims, or buys those claims from them. We always act on the basis of an authorisation or a contract with the creditor.
We're not a public authority or a court. Our job is to resolve the claim expertly, factually and lawfully — usually before the matter ever reaches a courtroom.
Why we're contacting you
Contact from DAVAR means that:
- •an unpaid obligation to the creditor exists,
- •the claim has been entrusted for expert handling or assigned,
- •previous attempts to resolve it were not successfully closed.
This is an active step by the creditor, who wants to properly settle their claim.
How claim resolution works
Attempt at an out-of-court agreement
We always first try to reach an out-of-court solution. An agreement is typically:
- ✓the fastest way to resolve the obligation,
- ✓the least costly option,
- ✓free of additional court and enforcement costs.
If an agreement isn't possible
If the debtor doesn't respond, refuses to communicate or breaks the agreement, the creditor can go to court without further notice. Enforcement follows, and the original debt usually grows significantly by:
- →statutory late-payment interest,
- →court proceeding costs,
- →legal representation costs,
- →enforcement proceeding costs.
The final amount can therefore be significantly higher than the original debt.
In exceptional cases — where there's good reason to suspect deliberate or fraudulent non-payment — the creditor may also consider criminal-law steps. That's a last resort, taken only when the circumstances and evidence genuinely justify it. More in the Debt Collection and Debt Purchase pages.
Your options
As a debtor, you always have the option to:
- •respond to the notice,
- •communicate your position,
- •submit relevant documents,
- •propose a way to settle the obligation or an agreement.
Getting in touch early and to the point sharply reduces the risk of court, enforcement and a growing debt.
Why an agreement is the best solution
- ✓the cheapest solution,
- ✓the fastest way to close the case,
- ✓it minimizes negative impact on both sides.
Court and enforcement are the last resort. They come into play only when an agreement fails or isn't possible.
Frequently asked questions
Does contact from DAVAR mean court proceedings are already underway?
Usually not. Contact from DAVAR represents an attempt at an out-of-court resolution. If no agreement is reached, the creditor has the right to pursue the claim in court.
What happens if I don't respond?
The goal is to have the debt paid. If the debtor avoids resolution, doesn't communicate or refuses an agreement, the logical and lawful consequence is pursuing the claim in court and subsequently through enforcement.
Can I dispute the claim?
If you have relevant reasons or documentation, it's best to communicate them in writing. Each case is assessed individually.
Who bears the risk in each procedure?
In a sale, the risk transfers to the new creditor. In collection, the risk of non-recovery remains with the creditor.
How to decide between selling and collecting?
The decision should be based on what the claim actually looks like — so it pays to have it assessed first.
